Satirical paper claims UW-L Student Association violated its free speech rights

A struggle has surfaced at the University of Wisconsin-La Crosse over distribution of a satirical newspaper on campus after it published an article that had Vice President Dick Cheney uttering a racial slur.

The UW-L Student Association voted March 29 to limit The Second Supper on campus to 900 copies per issue, split between three buildings, after several senators complained about the story.
About 2,000 copies per issue previously had been allowed on campus.

Patterned after The Onion, the free publication is meant to be satirical and provide a forum for alternative viewpoints, said owner and editor in chief Joe Gullo. It has UW-L student organization status but did not receive student government funding this year.

Although Gullo and several senators worked out the distribution limitation as a compromise, Gullo filed a complaint Wednesday in the UW-L student court that contends

the move violates First Amendment rights and is discriminatory because it singles out one group.

“In the compromise, I said repeatedly I would be willing to take part in discourse. This is the discourse I was talking about,” Gullo said.

Student senator Andy Monfre, who wrote for the publication when it started, said he suggested Gullo go to the student court.

“First Amendment rights should come first any time we have a conflict,” especially at a university, Monfre said.

While acknowledging the publication’s right to contest the decision, Student Association Vice President A.J. Clauss said the court complaint “knocked (me) off my feet.”

She argued the senate’s move, which she co-wrote, doesn’t violate free speech because it did not completely ban Second Supper from campus and will be in effect only through this academic year.

The item that caused the debate appeared in the Feb. 28 issue, and portrayed Cheney on a hunting trip with gang members in Washington D.C., some of which he ends up shooting. The article has Cheney using the n-word describe members of his hunting party.

Gullo has apologized verbally and in print for the article, but argued if context is irrelevant, a word should be offensive at all times.

He pointed to The Second Supper’s April 20, 2005, issue, which had a fictitious point/counterpoint between the late singer Sammy Davis Jr. and rapper 50 Cent. Both “opinions” used lyrics from singers’ songs; the 50 Cent side used the same racial word as the Cheney piece at least eight times.

No one complained then, Gullo said. The word is common in rap music, he added.

“Maybe nobody picked up his paper that week because it wasn’t any good,” said Bill Schultz, a student senator who unsuccessfully tried to revoke The Second Supper’s student organization status.

Schultz and Clauss contend The Second Supper contains “racist, sexist, homophobic, ablest, anti-Semitists speech” that threatens UW-L’s recruitment and retention of students from underrepresented groups.

Tom Pribek, one of the magazine’s faculty advisors, regards The Second Supper as a work of fiction. He said Gullo doesn’t mean to offend, and is following a tradition of humor that balances understatement and exaggeration.

Pribek, an associate professor of English, said the audience has to figure out the punch line.

The limitation comes as The Second Supper moves to downtown La Crosse, a decision Gullo said he made before the Student Association measure. Gullo plans to continue the publication after he graduates in May, focusing on broader community topics and adding features such as a live music calendar.

How does student court work?

The UW-La Crosse student court is convened when a student files a complaint.

Five justices — students appointed by the Student Association — consider the complaint.

Once received, the justices can decide whether to hear or decline the matter.

If they decide to proceed, a hearing is held in which the plaintiff and defendant can present their sides.

The justices then make a decision, which can be appealed to the UW-L chancellor, then the UW System Board of Regents.

" It's amazing how little some people do research before responding. The university DOES NOT give the SS any money at all. It is completely funded by advertisors. UWL agreed to allow us distribution with no strings attached. It is great now how the school has backed down completely and allowed us to continue our normal distribution numbers, along with the over 50 new locations all around town. " I'm a UW-L student and I support the Second Supper. A campus should be a place for free speech, even if people disagree with things that are said. Less than a week ago, there was a group of people on campus distributing anti-abortion material. In addition to pro-life messages, members of this group made statements that directly attacked minority groups, including homosexuals, moslems, and blacks. These were not made as jokes, as in the Second Supper, but as serious insults, and no one could do anything about it, because the people had the right to free speech.... "

" Lastly, the paper is not the cause of the lack of diversity at UWL. We've been behind on the 2008 plan since before the Second Supper. It is a result of what we cannot offer international students or just the diverse community. Our PR for diversity is lacking and did you ever think the chance of students coming here might be the result of cost? Do you know how much it costs for out-of-state/international students?? Instead of spending so much money on a staduim that we can hardly fill as it is... how about sending that money into scholarships for internationals to come here?? What about that??? We're so wrapped up in the staduim and other projects, all we do is up the tuition and forget the students! "

" Censorship is bull. We think we need to live in this ideal, happy world with no profanity, no alcohol, no violence, etc. etc. etc. But I hate to tell you this, it exists. And why not give it a twist? Make it entertaining? Yes violence, profanity, etc. is bad. But it's here, right now, and what better way to manipulate the bad into good? We'll never be able to stop students from getting wasted and we'll never be able to change students who believe certain things. IF you hate it so much, why the hell are you reading the paper in the first place? Have you not looked at the Easter board on campus every Easter? Check out how open-minded students are, then come back and review the paper. You'll be suprised about the racist comments made there. "

" Alright, this is what I have to say. First of all, the articles in the Second Supper are FICTIONAL. GET OVER IT. I too have been selected out in some of the articles, but I am not offended. Mainly because there is no truth in the paper. HELLO?!?! Can't you people get that? And since when do we all have to be ultra-conservative? What's the point? "Oh my! They incourage drinking!" You know what, it's not the Second Supper's fault that college students go get wasted every thursday. And did you know, that The Racquet use to have bar adds too? "

" Anyone who reads SS knows it's only satire. Not only students read it, but many of my non student friends as well. Gullo and the other writers are clever, witty, and intelligent! The next thing UWL is going to do is ban comedy central b/c of the Daily Show! People, lighten up. If you don't like it, don't read it. " The Second Supper is a refreshing outlook on the absurdity of life. The paper is very clever and fun to read,I attend UWL and I am happy that we have something to read other than The Racquet. " Let's get one thing straight. Minorities already go elsewhere to get their education, and it's not because of any "Onion-offspring" newspaper. They don't attend UW-L because this area is far from culturally diverse. As someone who grew up in a major metropolitan area, prejudice is still very prevalent. If you are not a white, midwestern-native, you still very much may be subject to racial slurs and predjudices. I have heard more taboo racial references in in the last 5 years that I've lived here, than I did in my 21 years growing up in a larger community. Regardless how you feel about the opinions expressed in the Second Supper, do not pawn off the lack of diversity at UW-L, and the La Crosse-area in general, on this publication. "

" Why is a for profit publication being allowed free distribution on a state operated campus in the first place? If they want to distribute their rag on campus, they should have to pay for the space. It is also ironic that the school is trying to discourage binge drinking, yet permits this publication that is financed primarily by ads for bars that promote students to get drunk the cheapest. "

" Heaven forbid we have to think about articles/issues and look deeper for the meaning of something between the lines. If you don't like the paper don't read it. In the interest of UW-L and its recruitment efforts let require everything, including stories and articles printed about it to go through a rigorous censoring process. I think a censor committee comprised of students, faculty, and regents should be formed. Go watch V for Vendetta. "

" As a minority attending UW-L I was shocked by the article. Actually, I am shocked, and disgusted about most of the articles written in there. I think that the Second Supper is worthless, and I'm glad the number of copies has decreased. I agree that it could put UW-L in a position where other minorites could go else where for a college education. "
