But voters should decide this case based not on negative ads or accusations made by special-interest groups on either side.
The race pits Linda Clifford, a 58-year-old Madison lawyer, against Annette Ziegler of West Bend, Wis., a 43-year-old Circuit Court judge. Based on their records and our conversations with both candidates, we believe Linda Clifford would be the better Supreme Court justice, a job that emphasizes legal scholarship and writing.
They bring different styles and skills to the Supreme Court race. Clifford has worked as a Wisconsin assistant attorney general and as a private attorney. She has handled cases involving environmental law, public employment, First Amendment and open government cases, family law and energy law. She has represented individuals and large corporations. And she has had extensive appellate court experience.
Ziegler has been a trial judge since 1997. She is the senior judge in Washington County and is the deputy chief judge for her judicial district. Earlier in her career she worked in the Milwaukee District Attorney’s office and as an assistant U.S. attorney.
Both candidates have accused the other of conflict of interest. Ziegler’s husband is a paid member of the board of directors of the West Bend Savings Bank. The Wisconsin State Journal and the Milwaukee Journal Sentinel reported that she had ruled on dozens of cases involving the bank, ruling in favor of the bank on most of them.
Ziegler has denied any conflict, even though Wisconsin’s judicial code of conduct calls upon judges to either withdraw from a case or inform the parties of the financial interest.
Ziegler countered by accusing Clifford of having a conflict because her husband is a trial lawyer who handles malpractice cases. Clifford responded by saying that her husband hasn’t had a case before the Supreme Court in 20 years, and she would respond appropriately when a case came up.
Clifford has not been a judge, but many Supreme Court justices never served on the bench before being elevated to the high court, including the current chief justice.
We think Clifford’s breadth of experience will serve her well on the court, and we are concerned about the appearance of conflict of interest that Ziegler presents.
