Commuting Libby’s sentence sends the wrong message

“When someone doesn’t tell the truth to the system, everyone suffers. The legal system suffers because we don’t know what the actual facts are. And, frankly, lots of other people suffer since, when you don’t know what the truth is, people draw all sorts of conclusions.”

That’s how U.S. Attorney Patrick Fitzgerald explained the issues at stake in the trial of I. Lewis “Scooter” Libby, a top aide to Vice President Dick Cheney. Libby was convicted of perjury and obstruction of justice in the case involving the outing of Valerie Plame as a CIA covert operative.
A jury unanimously found Libby guilty of two counts of perjury, one count of obstructing justice and one count of making false statements about when he learned of Plame’s identity.

He was fined $250,000 and sentenced to 30 months in federal prison. But he won’t serve that time because President Bush commuted the sentence.

The president contended that, although the trial was fair and the verdict was just, the sentence was somehow “excessive.”

Bush’s actions — short of a pardon but still showing a degree of lenience that less powerful defendants often do not receive — are outrageous.

Instead of interfering in the justice system, the president should have let the system play out. Libby should have been required to serve whatever sentence he was given.

It’s interesting to note a recent story in The Washington Post, which said Bush did not consult more than a handful of close aides on the issue. The president did not even consult with the Justice Department.

The decision will be controversial on all sides. Many Americans will not make the distinction between a full pardon and simply commuting the prison sentence.

And some conservatives will be angry because Bush did not pardon Libby.

But it seems to us that the message the president sends with this act of executive clemency is to tell the nation that if you do the crime, you do the time — unless you are powerful and well placed in government. That’s no message to send.
