Defense: Ramirez found injured woman and stopped to help

.
The man accused of killing a University of Wisconsin-Stevens Point student in January will testify he found her already battered and tried to help her before panicking and leaving her with his cell phone, his attorney said Tuesday.

Defense attorney Ronald Benavides ended his brief opening remarks by telling jurors Irvin Ramirez, 25, did not harm 23-year-old Danielle Gorectke of Minocqua, Wis., whose half-nude body was found outside a church on Hwy. B the morning of Jan. 21.

Testimony opened Tuesday in the trial of Ramirez, of Onalaska, Wis., who is charged with first-degree intentional homicide, attempted second-degree sexual assault and robbery in the death.

“(Ramirez) will testify that he did have contact with the young lady, that he came upon her already hurt and he tried to help her. He gave her his cell phone and left the scene ... ,” Benavides said.

Benavides’ remarks came after La Crosse County District Attorney Tim Gruenke laid out evidence he claimed directly tied Ramirez to Gorectke’s death.

Ramirez’s DNA was found on Gorectke’s buttocks, under her fingernails and on a piece of human tissue ripped from Gorectke’s lip, Gruenke said.

A search of Ramirez’s car turned up Gorectke’s fingerprints, her DNA on a water jug, and bloodstains on the driver’s side door and driver’s floor mat, Gruenke told the jury.

Gorectke’s DNA also was found on Ramirez’s genitalia and her blood was on his shoes, pants, watch, jacket and hands, Gruenke said.

Houston County Sheriff’s Chief Deputy Scott Yeiter testified Tuesday about arresting Ramirez about 4 a.m. Jan. 21 outside a La Crescent, Minn., Kwik Trip on suspicion of drunken driving.

Yeiter, then a La Crescent police officer, said Ramirez had Gorectke’s purse in his vehicle and was wearing gloves that covered his bloody hands and black pants over denim jeans that also were covered in blood.

Jurors were shown large autopsy photos as Dr. Susan Roe, the forensic pathologist at the Southeastern Minnesota Medical Examiner’s Office in Hastings, Minn., detailed Gorectke’s extensive injuries.

Roe said the death was caused by multiple traumatic injuries due to an assault. The amount of blood at the scene indicates the fatal beating took place outside the church, but Roe said it was impossible to determine how long it took Gorectke to die.

In cross-examining Roe, Benavides asked whether the injuries could have been from an accidental fall and whether the weather or amount of alcohol Gorectke had consumed played a role in the death.

Roe said the extent of the injuries makes it unlikely they were accidental: The 23-year-old had at least 25 separate injuries, including one to her spine that likely left her partially paralyzed. Her head might have been rammed into an object or stomped, Roe said, and a portion of her lip was gone and perhaps bitten off by someone else.

Although the autopsy failed to show any signs, Roe said that does not mean Gorectke was not sexually assaulted.

Gorectke’s sister, Michelle, testified the two became separated Jan. 21 about closing time at The Helm Bar after celebrating Michelle’s 21st birthday.

Snowplow operator Terry La Fleur told jurors he found Gorectke’s snow-covered body about 8 a.m. later that day while clearing the parking lot at Christ Covenant Church, 3630 Hwy. B.

Several La Crosse police officers and investigators testified about finding Ramirez’s cell phone not far from Gorectke’s body. The last call made was to Gorectke’s mother at 3:12 a.m., and lasted three seconds, police Sgt. Dave Schatzley said.

Julie Schupple, a sexual assault nurse examiner with Gundersen Lutheran Medical Center, said Ramirez had cuts and abrasions on his hands when examined at the Houston County Jail on Jan. 21.

Before the examination, Ramirez was seen at the jail licking blood from his fingers to try to hide the evidence, Gruenke said.

The trial will resume at 9 a.m. today in La Crosse County Circuit Court.

" What an absolute p.o.s, no doubt. I feel so bad for the victim's family. I can only imagine how hard it is to contain themselves while looking at this loser in court. "Licking the blood off his hands"...not the brightest kid either. Maybe before you licked your hands you should've thought about not leaving your cell phone at the scene or stealing her purse or going to Kwik Trip with her blood all over your clothes. This is EXACTLY why we need the death penalty. "

" And this is just the beginning. We shall hear about this creature for a good 7 years with all the various appeals that will be filed. What scum. Useless scum. Yet, even useless scum deserves a fair trial in the USA. Then, when he is found guilty for the Nth time (after appeals), send him to prison where the taxpayers pay his room and board for the rest of his life. He's 25 now....could be a long lease... "

" Why publish this, Chronic? Because the web version of The Trib doesn't have a "funny papers" section. Like the others have said, the lawyer piled it pretty high with this one. Maybe that was to set up an appeal. You know, only incompetent legal help would offer such an explaination. "

" This Ramirez sounds more like an animal than a human!!! He was seen licking the blood off his hands to try to hide evidence???? Maybe he is just ignorant, but sounds like he isn't all there. He should be caged like an animal. "

" What a load of crap! he is a pig! how can you sit in the dourt room, laugh, smile and joke with your friends knowing that you murdered someone who will never be able to smile and laugh with her family and friends again? Give me a break, he didn't find her injured in a church parking lot and try to help her, he beat her and dumped her there. He deserves life in prison with some boys who will find him very attractive! "

" I'm not sure her BAC is relevant to getting murdered. abs...I concur with you; the defense can only go off of what his client says. If they're going to stand on this story...this shouldn't take the jury long for a decision. "

onawom1 wrote on Nov 28, 2007 8:04 AM:

" Okay, other than the fact that he is obviously lying his behind off, there are a few things wrong with the "defense." What on earth was Ramirez doing just wandering around outside a church in the middle of the night when it was freezing cold outside when he happened to stumble upon this injured woman? And why did he feel the need to take her wallet and purse with him when he so "kindly" left her his cell phone??? I agree...how does this defense lawyer sleep at night?? Such terrible awful details...I feel so awful for Danielle's family. I pray for them and that this gets resolved QUICKLY! "

abs29 wrote on Nov 28, 2007 7:43 AM:

" I do not think that it is better this way. According to the way our criminal justice system works, both sides are supposed to argue for the truth. We have the courts, so the the truth can emerge. His lawyer does not have to lie; however, the lawyer can only go off what his client tells him and perhaps this is what Ramirez told him. "

ollie wrote on Nov 28, 2007 7:29 AM:

" That's pretty sloshed....BTW I wonder why in 15 years of living here in the US this Mexican citizen hasn't learned to speak enough English to communicate? It further goes to prove that these people don't come here to be Americans they come for the cash, crime, and to take their land back that we beat them up fair and square for. "

returntosanity wrote on Nov 28, 2007 7:28 AM:

" Although I agree with those of you that think this defense lawyer is an idiot for this defense he really has no choice. Some defense must be given somthing that at least attempts to show reasonable doubt otherwise Ramirez will have grounds to get everything thrown out on appeal because of defnse incompetence. It's actually better this way because then when he goes to prison he will stay put. Instead of being released on a technicality. "

abs29 wrote on Nov 28, 2007 6:27 AM:

" This is absolutely absurd. I've heard of crazy defenses before, but this is out of line. I'd say it is more than clear that her injuries were not due to an "accidental fall". Of course he will argue that we cannot be 100% certain. I give my sympathy to Danielle's family for having to sit through this. I hope that he will pay in the end for the pain he caused everyone involved. "

Does this defense attorney not realize what kind of trauma he or she could be causing Ms. Goreckte's family? This guy was licking blood off his hands? How sick is this going to get? "
