Other view: End-game nears for Guantanamo

Clearly, the Bush administration hoped it would never come to this, but a day of reckoning over detainees in Guantanamo is approaching quickly. Lawyers for the Justice Department appeared in a Washington federal courtroom Tuesday to argue for yet another delay in deciding how to deal with most of the 270 individuals who remain confined at the island prison, only to be rebuffed by a stern judge. “The time has come to move these forward,” Judge Thomas F. Hogan told the lawyers. “Set aside every other case.”

It’s about time — in fact, long overdue. The hearing was the direct result of the recent Supreme Court ruling that granted detainees the right of habeas corpus — the right to ask the government why they are confined. Incredibly, some of the detainees have been held since 2002 without trial. But even more incredible was the Justice Department plea at Tuesday’s hearing: It asked for a delay of eight more weeks so it could update and add to the evidence used originally to justify holding the detainees.
To its credit, the court was skeptical, to say the least. Judge Hogan said he could not fathom why evidence would suddenly have to be changed if it had been considered strong enough to warrant holding the detainees for periods of up to six years. “If it wasn’t sufficient, then they shouldn’t have been picked up,” the judge declared.

Judge Hogan’s admonition may have come as a shock to government lawyers, given that the Guantanamo process has been devoid of either common sense or legal logic since its inception.

In the immediate aftermath of 9/11, confronting a new kind of enemy, the administration created a new kind of prison where standard rules of evidence and procedure used in military and civilian courts did not apply. Six years on, the courts are saying it’s time to get back to playing by the rules.

If they’re wise, the Justice Department lawyers will comply. Judge Hogan is in charge of processing Guantanamo cases for eight of the nine federal judges in Washington who will deal with the 200 or so pending habeas corpus motions. His ruling and others have made it abundantly clear that the detainees cannot be held indefinitely just on the government’s say-so. That is the compelling reason for these cases to move ahead without delay.

In cases where the government’s evidence is either weak or nonexistent, judges will be able to order suspects released, but they lack authority to bring detainees into the United States. That’s why the Bush administration should be working overtime to find countries that will take them back. It has managed to stall for six long years, but the day of reckoning is around the corner.

" I really don't know what was so hard for the Supreme Court to understand here. These are unlawful enemy combatants who must appear before a military tribunal. They are not citizens and they do not deseerve to be seen in civilian courts. Military law operates different than civilian law and the supreme court had no business getting involved. Where are the checks and balances on this one? Every one of the remaining detainees should just be shot. It would be alot more humane than what they would do with a captured American. "

" ummm LAX, i do know about the Constitution. could you please show me in it where there is any mention of rights of NON citizens? also you said OUR courts, so i would assume you are referring to American courts? you know, where American trials are held or where foreign nationals are sent if they commit crimes ON OUR soil. hence that is why we want to send them back to their own country. and apparently these are the worst of the worst and their countires don't want them back. if no one wants them then the UN should be the body to deal with them, but fat chance of that, all the UN can do is debate things endlessly, sort of like our Congress. "

The Court said bring them to trial forthwith so that their guilt or innocence can be established. After seven years in detention one wonders whatever happened to presumed innocent until proven guilty? If guilty, then they should be punished. And isn't it funny that the Government says they need another 8 weeks to develop evidence when they've already had 7 years! If innocent, let 'em go. Maybe we should lock up RAB until he learns how the Constitution and our courts are supposed to work -- as opposed to how Bush says they should work. "

" If some of us REALLY want a 'fascist' (or as George W Bush would put it a 'facist') state, the abrogation of the constitution for the 'select' is the way to go. Star chamber courts and permanent suspensions of habeas corpus make light of Jefferson et. al., and suggest that Mussolini may be the model 'leader' we actually want. But some courts still regard that constitution as 'in effect' and prefer Jefferson -- good! We're 'fighting for freedom' we say -- well a fair and SPEEDY trial is a big part of that in practicality. I commend our judicial system, which 'works' at last... "

" i can't believe it, there seems to be an 'editorial' board out there that is more clueless than the Tribs. the intention was never to hold enemy combatants forever, and many have been turned back over to their home country (one was killed in a suicide bombing, others killed or rearrested). as for the ones still there? apparently no one wants them back. could this be they are the worst of the worst? i equate these enemy combatants with the career criminals we have in this country. you can let em go, but they will just reoffend, "
