Scott J. Johnson of Kingsford, Mich., waived his right to a preliminary hearing during a brief court appearance today. A judge set a Sept. 5 hearing for the 38-year-old Johnson to enter a plea to three counts of first-degree intentional homicide.

Johnson's attorney says he may plead insanity.
Prosecutors say Johnson went to the Menominee River on July 31 and opened fire on a group of swimmers, killing three and injuring one.
He remains in jail in Wisconsin on a $3 million cash bail.
A preliminary hearing is for prosecutors to convince a judge that there is enough evidence to warrant a trial.
