West Salem principal back on job

The West Salem Elementary School principal fired in January and placed back on paid administrative leave in April will return to his position at the school Tuesday, the West Salem School District said.

After “a thorough and complete investigation and review of the evidence,” an investigator determined there was insufficient evidence to proceed with a termination hearing or any other discipline against John J. Smalley, the school board said in a news release.
The board’s original decision to fire Smalley was made on the advice of legal counsel and based on that legal counsel’s investigation, the board said. Soon after the termination, the board said, it learned “it had received erroneous legal advice regarding its decision.”

Smalley was reinstated, reimbursed the salary and benefits he would have received, and placed on paid administrative leave so the board could hire new legal counsel.

“Based on the information provided by the new investigator and the advice provided by the new counsel, the school board was advised that it never should have removed Mr. Smalley from his duties as principal or terminated Mr. Smalley’s contract in the first place,” the school board said.

Superintendent Nancy Burns and school board president Errol Kindschy declined to comment further on the personnel matter.

Smalley was fired Jan. 25, for “neglect of duty and dishonesty surrounding his job performance in recent months.” He had been principal since July 2005.

He was originally placed on administrative leave Dec. 11, 2007, two days after he was arrested in connection with a domestic disturbance with his wife.

Smalley was charged with battery and disorderly conduct in La Crosse County Circuit Court but pleaded guilty March 5 to disorderly conduct in return for dropping the battery charge. The disorderly conduct charge also can be dismissed in a year if Smalley meets conditions of the agreement.

Smalley filed a discrimination complaint and notice of claim against the district in March.

In the discrimination complaint, filed with the Wisconsin Department of Workforce Development’s Equal Rights Division, Smalley contends that his firing stemmed from his arrest and violated the state’s Fair Employment Act.

The West Salem School Board has started the process of pursuing recourse against the legal counsel its says gave bad advice.

Smalley is also evaluating what additional legal remedies he might have against the school district.

In Smalley’s absence, West Salem High School Principal Barbara Buswell was made the interim principal, while high school physical education teacher Mike Malott took over as interim high school assistant principal.

Kindschy said Buswell has been offered her original position as well as another within the district. Her decision will determine what happens with Malott and the long-term substitute who replaced him.

" andyk do you think your taxes won't go up if we do nothing? We've talked to the police, staff, board members and administrators and have been told the same thing, every opinion counts. Also the complaint forms can be filled out by parents, students, employees and other people. The board has to act on each signed form. If you do not have a specific instance with dates you may fill it out with your feelings on the subject. These forms will be in a separate pile to add beef to the forms that have instances that can be investigated. "

" Andy k, you are wrong. Smalley cannot get more money because parents file a board-approved complaint form! And as far as picketing, it is a free country. Parents have every right to feel angry and every right to take action to the next level.

By the way, the complaint forms are in EVERY school office in West Salem, not just the elementary. Any WS parent can file one. "

" Every picket sign, every complaint filed, every child kept home from school will lead to more money for Mr. Smalley when the school district finally settles this once and for all. If you're dumb enough to do these things, be prepared to watch your property taxes increase. "

" The school board can no longer touch Mr. Smalley legally. It is now in the hands of the parents. As parents we need to let them know that we won't accept this person as our leader. To that effect, we are encouraging people to fill out complaint forms for them and their children, sign our petition(at school starting Mon), keep your elementary kids home from school on Tuesday 9-9 (his first day back) and join our picket line on Tuesday (you'll need to bring your own sign-NO profanity). We can no longer just talk about how disgusted we are, we have to act on this. We can make a difference. Please join us. "

" I hope that Mr. Smalley will work a full day unlike he had previous to his termination. Although, I guess we will have to understand when he needs March 5th off to go plea his domestic battery and disorderly conduct case in court. We should be so proud that we have such a great role model for our children to aspire to be. I really hope that he lectures our children on bullying. He is a great model as how to not take advantage of your position in your employment and at home! "

" Does anyone remember the Robert Fortney case in the 80's? Same old West Salem School Board thinking the world revolves around it and it does not have to follow the mandates of employment law. And you good citizens of West Salem once again pay dearly for the Board's arrogance. I'm glad I got out. "

" I tried posting here twice yesterday and my comments kept getting censored. I completly agree with Jaxx. Mr. Smalley fails to reach the standards that are assured to us in our Mission Statement from the West Salem Schools. Please pick up your complaint forms in the Elementry School office and file a formal complaint. Mrs. Burns and Mr. Smalley need to be held accountable for their actions. Mr. Smalley needs to go before his "anger issues" Involve a student! "

I'm sorry, but like I've said before, there is a level of standards that people around children must exhibit. What does this say about this man? What is he teaching the kids that he is around? That it is okay to beat on women if you are in a leadership position or that you can do anything you want as long as you have a good attorney? "
