Madison woman accused in baby's death may not be prosecuted

MADISON, Wis. (AP) — The public defender for a Madison mother accused of causing the death of her infant daughter says the woman may never be prosecuted because of her mental disability.

Twenty-four-year-old Ee Lee is charged with first-degree intentional homicide, first-degree reckless endangerment and two counts of child abuse in the July 2007 death of 6-week-old Anastasia.
Dane County Assistant District Attorney Robert Kaiser says he won't challenge a finding by psychologists that Lee will not become competent to stand trial anytime soon and that she should be evaluated further.

Although Lee was treated for psychosis, Assistant Public Defender Ellen Berz says psychologists at Winnebago Mental Health Institute determined that Lee has the mental intellect of an 8-year-old.

" I know of a case where a 18 yr old mentally challenged woman was raped in the park, she had no clue on what was happening. Do you sterilize every woman in this condition or Elaina Bobbit is called. (who is the victim?)
The problem is that you can't watch everyone 100% of the time, but this mom needs protection as much her child did. "

" Maybe we shouldn't let people with the intellect of an eight year old have children. I'm sure she was completely overwhelmed with an infant, and the baby paid with its life. "

" Does anyone think that the social worker involved should be responisble for not looking out for the best interest of this child?
If they had tried to get the child into foster care, are the judges responsible for keeping a child in the care of a 8 yr old like woman.
I would have never left a baby in the care of an 8 yr old, NEVER! Who is speaking out for this child? Where are the grandparents? "
